K-1 Fiancé(e) Visa & K-3 Spousal Visa
At the Law Offices of Cindy Ramjattan-Paul, P.C., we help U.S. citizens reunite with their fiancé(e)s and spouses through family-based immigration. Whether you are planning to marry in the United States or seeking to bring your husband or wife to live with you permanently, our experienced immigration legal team provides strategic guidance throughout every stage of the immigration process.
We understand that family separation can be emotionally and financially difficult. Our goal is to help couples navigate the immigration process efficiently while ensuring full compliance with U.S. immigration laws and USCIS requirements.
K-1 Fiancé(e) Visa
The K-1 Fiancé(e) Visa allows the foreign national fiancé(e) of a U.S. citizen to travel to the United States for the purpose of marrying the U.S. citizen petitioner.
To qualify for a K-1 visa, applicants generally must satisfy the statutory requirements established under the Immigration and Nationality Act, including:
Qualifying Relationship: The petitioner must be a United States citizen, and both parties must be legally free to marry.
Intent to Marry: The couple must intend to marry within 90 days after the foreign fiancé(e)'s lawful admission into the United States.
Meeting Requirement: In most cases, the couple must have met in person during the two years immediately preceding the filing of the petition unless a statutory waiver applies.
After the marriage takes place, the foreign spouse may generally apply for Adjustment of Status to become a lawful permanent resident (Green Card holder), provided all eligibility requirements are satisfied.
K-3 Spousal Visa
The K-3 visa was created to reduce lengthy separations between U.S. citizens and their foreign national spouses while immigrant visa petitions were pending. Although the K-3 visa category remains authorized under federal law, it is used far less frequently today because many petitions are administratively closed once the underlying immigrant visa process reaches the National Visa Center (NVC).
Depending on the circumstances, many married couples now complete the immigration process through a CR-1 or IR-1 immigrant visa or, when eligible, through Adjustment of Status within the United States.
Our office carefully evaluates each family's circumstances to determine the most efficient immigration strategy under current USCIS and Department of State procedures.
