Employment-Based Immigration: Religious Worker Visas

At the Law Offices of Cindy Ramjattan-Paul, P.C., we provide experienced legal representation for religious organizations, churches, ministries, and religious workers seeking employment-based immigration benefits in the United States. Our office assists clients with R-1 Religious Worker Visas, employment-based immigration for religious workers, Adjustment of Status, extensions of stay, and related immigration matters before U.S. Citizenship and Immigration Services (USCIS).

We understand the important role that religious organizations play in serving their communities, and we are committed to helping eligible religious workers lawfully live and work in the United States.

Religious Worker Immigration

U.S. immigration law provides several immigration options for qualified religious workers. Depending on your circumstances, you may qualify for temporary employment authorization through an R-1 Religious Worker Visa or, where authorized by federal law, employment-based permanent residence for qualifying religious workers.

Because these immigration categories contain detailed statutory and regulatory requirements, experienced legal guidance is essential for both the sponsoring religious organization and the applicant.

R-1 Religious Worker Visas

The R-1 visa is a nonimmigrant visa that allows qualified religious workers to temporarily enter or remain in the United States to work for an eligible nonprofit religious organization.

In general, applicants must satisfy several requirements, including:

Religious Membership: You generally must have been a member of the same religious denomination as the sponsoring organization for at least two years immediately preceding the filing of the petition.

Qualifying Religious Employment: You must be coming to the United States to work as a minister or in a qualifying religious vocation or religious occupation as defined under U.S. immigration law.

Qualified Religious Organization: The petitioning organization generally must be a bona fide nonprofit religious organization in the United States or an organization affiliated with a recognized religious denomination that qualifies under applicable federal law.

Employment Requirements: The offered position must satisfy all applicable immigration requirements, including compensation or qualifying support arrangements where permitted by law.

USCIS may conduct site inspections and request additional documentation to verify the legitimacy of both the sponsoring organization and the offered religious position. Careful preparation of the petition and supporting evidence is critical to a successful application.

Employment-Based Permanent Residence for Religious Workers

Certain religious workers may qualify for employment-based permanent residence under the Immigration and Nationality Act if they satisfy all statutory eligibility requirements established by Congress.

Depending on the applicable category and current federal law, applicants may be required to file Form I-360 and may later become eligible to apply for lawful permanent residence through Adjustment of Status or Consular Processing.

Because these immigration categories are subject to changes in federal legislation and visa availability, our office carefully evaluates each case under the current law in effect at the time of filing.
