Family-Based Immigration

Reuniting Families Through U.S. Immigration Law

Family unity has long been a cornerstone of the United States immigration system. At the Law Offices of Cindy Ramjattan-Paul, P.C., we are dedicated to helping U.S. citizens and lawful permanent residents reunite with their loved ones by navigating the family-based immigration process with experienced legal guidance and personalized representation.

Based in Bloomfield, New Jersey, our firm represents families throughout New Jersey, across the United States, and internationally in family-based immigration matters before U.S. Citizenship and Immigration Services (USCIS), the National Visa Center (NVC), U.S. Embassies and Consulates, and Immigration Courts when necessary.

Understanding Family-Based Immigration

Family-based immigration allows eligible U.S. citizens and lawful permanent residents to petition for certain qualifying family members to obtain lawful permanent residence (a Green Card) in the United States. Depending on the family relationship, applicants may qualify through either the Immediate Relative category or the Family Preference category established under the Immigration and Nationality Act (INA).

Because immigration laws, filing requirements, and government policies continue to evolve, having experienced legal representation can help avoid unnecessary delays, Requests for Evidence (RFEs), and other complications throughout the process.

The Role of an Experienced Family Immigration Attorney

Every family's circumstances are unique. Our office provides individualized legal strategies tailored to your specific immigration goals. We guide clients through every stage of the process, from determining eligibility and preparing petitions to responding to government requests, preparing supporting documentation, and assisting through consular processing or adjustment of status.

Whether your case is straightforward or involves prior immigration violations, waivers, or other legal complexities, we work diligently to protect your family's interests and pursue the most effective path toward lawful permanent residence.

Our Family Immigration Services Include

Family-Based Green Card Petitions: Representation for immediate relatives and family preference categories.

Marriage-Based Immigration: Green Cards for spouses of U.S. citizens and lawful permanent residents, including Adjustment of Status and Consular Processing.

Fiancé (K-1) Visas: Assistance with K-1 fiancé visa petitions and the subsequent adjustment of status process after marriage.

Children and Parents: Petitions for children, parents, and other qualifying relatives under U.S. immigration law.

Consular Processing: Representation throughout the National Visa Center (NVC) process and immigrant visa interviews at U.S. Embassies and Consulates worldwide.

Waivers of Inadmissibility: Legal representation for applicants who may require provisional waivers or other waivers before obtaining lawful permanent residence.

Immediate Relative and Family Preference Categories

Immediate Relative Immigrant Visas: Immediate relatives of U.S. citizens—including spouses, unmarried children under 21 years of age, and parents of U.S. citizens who are at least 21 years old—are generally not subject to annual visa limits.

Family Preference Immigrant Visas: Other qualifying family relationships, including certain adult children and siblings of U.S. citizens and qualifying relatives of lawful permanent residents, are subject to annual numerical limitations established by Congress. Visa availability depends on the applicable preference category and priority date.

The Family Immigration Process

Although every case is different, family-based immigration generally begins with the filing of Form I-130, Petition for Alien Relative. Depending on the applicant's circumstances, the process may continue through Adjustment of Status within the United States or Consular Processing at a U.S. Embassy or Consulate abroad.

Successful applications require careful preparation, including documentation establishing the qualifying family relationship, financial sponsorship, admissibility under U.S. immigration law, and compliance with all USCIS and Department of State requirements.

Because processing times vary based on visa category, government workload, country of chargeability, and visa availability, our office closely monitors each case and provides guidance throughout every stage of the process.
