Adjustment of Status Under U.S. Immigration Law

Adjustment of Status Under U.S. Immigration Law

At the Law Offices of Cindy Ramjattan-Paul, P.C., we help eligible individuals apply for lawful permanent residence (a Green Card) without leaving the United States through a process known as Adjustment of Status. Adjustment of Status allows certain individuals who are physically present in the United States to become lawful permanent residents without completing immigrant visa processing at a U.S. Embassy or Consulate abroad.

Because eligibility requirements vary depending on the applicant's immigration history, manner of entry, family or employment relationship, and other factors, Adjustment of Status is one of the most complex areas of U.S. immigration law. Our experienced legal team carefully evaluates every case to determine the most effective strategy under current immigration law.

Understanding Adjustment of Status

Adjustment of Status is available to many individuals already present in the United States who qualify for permanent residence under the Immigration and Nationality Act (INA). Eligibility depends on several factors, including the immigration category, visa availability, admissibility, and compliance with applicable immigration laws. Certain applicants who entered without inspection or who have violated their immigration status may still qualify under specific statutory provisions or humanitarian programs.

Our office carefully reviews each client's immigration history to determine eligibility before any application is filed.

The Adjustment of Status Process

Most family-based Adjustment of Status cases begin with the filing of Form I-130, Petition for Alien Relative, by a qualifying U.S. citizen or lawful permanent resident family member. Employment-based and humanitarian cases follow different filing procedures depending on the immigration category.

Once eligible, applicants generally file Form I-485, Application to Register Permanent Residence or Adjust Status. Depending on the case, supporting applications may also include employment authorization, advance parole travel permission, affidavits of support, medical examinations, and other required documentation.

In many family-based cases involving immediate relatives of U.S. citizens, the immigrant petition and Adjustment of Status application may be filed concurrently when permitted by law. Other applicants must wait until an immigrant visa becomes available according to the Department of State Visa Bulletin before filing.

Biometrics, Interviews, and USCIS Review

After filing, USCIS typically schedules applicants for biometric services, including fingerprinting and background checks. Many applicants are also scheduled for an interview with a USCIS officer, particularly in family-based cases, although interview requirements may vary depending on the type of application and current USCIS policies.

USCIS reviews the entire application, supporting evidence, eligibility requirements, and admissibility before issuing a final decision. If approved, the applicant becomes a lawful permanent resident of the United States and receives a Permanent Resident Card (Green Card).

Addressing Complex Immigration Issues

Adjustment of Status cases often involve legal issues that require careful analysis, including prior immigration violations, unlawful presence, criminal history, prior removal proceedings, unauthorized employment, public charge considerations, Requests for Evidence (RFEs), Notices of Intent to Deny (NOIDs), and questions regarding admissibility.

Our office develops individualized legal strategies to address these issues and, when appropriate, assists clients with waivers of inadmissibility or other forms of immigration relief that may allow an application to proceed.
